These Terms of Service ("Terms") govern your access to and use of the websites, products, and services provided by Elevatech Fund LLC ("Elevatech Fund", "we", "us", or "our"). By accessing or using our sites or services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Who we are

2. Services

We provide: (a) ecommerce brand websites and related content; (b) software tools and dashboards; and (c) B2B technology services including store builds, integrations, analytics, and automation.

3. Compliance and payments

We process payments for our own brands only. We do not process payments on behalf of third parties and we are not a payment facilitator. Payments for Swiss customers may support TWINT via partners on applicable brand stores.

4. Eligibility and accounts

You must have the legal capacity to agree to these Terms. If you create an account for any of our tools, you are responsible for safeguarding your credentials and for all activity under your account.

5. Acceptable use

Do not misuse our services. Prohibited conduct includes: illegal activities; infringing intellectual property; attempting to bypass security or access non-public systems; interfering with service integrity; and reselling, sublicensing, or reverse engineering except as permitted by law.

6. Intellectual property

We retain all rights, title, and interest in our websites, software, content, and trademarks. You receive a limited, non-exclusive, non-transferable license to access and use our services for their intended purpose.

7. Third-party services

Our services may interoperate with third-party platforms (e.g., Shopify, Stripe) or include links to third-party content. We do not control and are not responsible for third-party services or terms.

8. Fees

Certain services or software may be offered for a fee. Prices, billing cycles, and taxes will be disclosed at purchase. Unless stated otherwise, fees are non-refundable except where required by law.

9. Privacy

Our Privacy Policy explains how we collect and process personal data. By using our services, you consent to our data practices as described there.

10. Disclaimers

Services are provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee that the services will be uninterrupted, secure, or error-free.

11. Limitation of liability

To the maximum extent permitted by law, Elevatech Fund will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill. Our aggregate liability arising out of or relating to the services is limited to the amounts you paid to us for the services that gave rise to the claim in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold Elevatech Fund harmless from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the services or violation of these Terms.

13. Termination

We may suspend or terminate access to the services at any time, with or without cause. Upon termination, your right to use the services will cease immediately.

14. Governing law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict of law principles. Venue and jurisdiction lie in courts located in New Mexico, USA.

15. Changes to these Terms

We may update these Terms from time to time. The updated date will be indicated at the top. Material changes will be highlighted where reasonable. Continued use constitutes acceptance of the updated Terms.
